TASIKMALAYA DISTRICT (2024/26/06). Article 27 paragraph 3 of the ITE Law states that it prohibits every person from intentionally and without the right to distribute and/or transmit and/or make accessible Electronic Information and/or Electronic Documents that have insulting and/or defamatory content.
Related to this, today Tuesday (25/5/2024) BPPH MPC Pancasila Youth Tasikmalaya Regency has coordinated with the police to follow up on reports related to alleged criminal acts on tiktok social media committed by the tiktok account @z*m² regarding alleged acts of insult / harassment against the Pancasila Youth Organization of Tasikmalaya Regency.

This problem began when one of the officials of the Tasikmalaya Regency Pancasila Youth MPC posted a video of the organization's activities at Puspahiyang, in the post then there were negative comments or hate speech that had the muata of insulting and harassing the content in the video. Therefore, when viewed in content and context, from information and data electronically the account comments have mens-rea or bad intentions to attack the honor, dignity, and defame the Pancasila youth organization.
Advocate Ecep Sukmanagara, S.Pd. S.H as BPPH MPC PP Tasikmalaya Regency followed up on this matter.
*For this incident, our organization then confirmed and clarified the account owner, and after meeting that based on his statement the owner of the tiktok account @z*m² stated that in making comments on the post in a state of consciousness. That confirms that what he did was intentional, therefore, in the line of command of the organization based on the results of deliberations with the PAC chairmen and MPC PP management, we reported this to law enforcement officials in this case the Tasikmalaya Regency Police through the summary unit." Ecep Sukmanagara said.
Our reporting is related to the defamation article on social media, which in addition to the Criminal Code can also refer to Article 27A jo. Article 45 paragraph (3) of Law 1/2024, which stipulates that every person who intentionally attacks the honor or good name of another person by alleging a matter, with the intention that it becomes publicly known in the form of electronic information and/or electronic documents carried out through an electronic system shall be sentenced to imprisonment for a maximum of 2 years and/or a maximum fine of Rp400 million. Ecep added.
"Furthermore, what is meant by "attacking honor or good name" is an act that degrades or damages the good name or dignity of another person to the detriment of that person, including defamation and/or slander." Ecep concluded.
